1. Who we are

Shiftwell is operated by Nneoma Isinguzo ("we", "us", "the seller"). By creating an account or continuing to use Shiftwell, you agree to these Terms of Service and enter into a contract with Nneoma Isinguzo. If you use Shiftwell on behalf of an organization, you confirm you have authority to bind that organization; otherwise you confirm you are of legal age in your jurisdiction.

2. The service

Shiftwell is a calendar app for nurses, residents and shift-based clinical staff. It lets you log rotating shifts, track sleep and fatigue, estimate overtime and differential pay, and share your schedule with family or colleagues through revocable links. A free tier covers the basic calendar; a Premium subscription ($4.99/month) unlocks overtime analytics, fatigue-safe shift insights and multi-platform calendar sync.

Shiftwell is a personal organization tool. It is not medical, financial, legal or tax advice, and pay figures are estimates — always verify against your employer's official records.

3. Your account

You must provide accurate information and keep it updated. You are responsible for keeping your login credentials confidential and for all activity under your account. Schedule share links you create are your responsibility: anyone with a link can view the shared schedule until you revoke it.

4. Acceptable use

You must not misuse Shiftwell. That includes:

  • Using the service for anything unlawful, fraudulent or deceptive, including spam.
  • Infringing anyone's intellectual property or privacy rights.
  • Interfering with the service's security — introducing malware, probing or scanning vulnerabilities, or scraping the service or other users' data.
  • Reverse engineering, reselling or redistributing the service, or circumventing plan limits.

5. Intellectual property

We retain all ownership of Shiftwell and its intellectual property, including the software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You keep ownership of the content you enter (shifts, notes, wellness logs); you grant us a limited license to host and process that content solely to provide the service to you.

6. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms). Premium renews monthly at $4.99 until cancelled; you can cancel at any time and keep Premium access until the end of the paid period. See our Refund Policy for refund details.

7. Service level and warranties

We work hard to keep Shiftwell reliable, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it. You indemnify us against claims arising from your content, unlawful use of the service, or your breach of these terms.

9. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may delete your account at any time. When access ends, your data is deleted within a reasonable period; export anything you need beforehand.

10. General

We are not liable for failures caused by events beyond our reasonable control. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. These terms are governed by the laws of the seller's jurisdiction, and disputes will be resolved in its courts. If any clause is unenforceable, the rest remain in effect. We may update these terms; continued use after changes means you accept them.
